By checking this box I agree to the following:
I knowingly and voluntarily assume all risks, hazards, and dangers described above, as well as any injury, damage, loss, or harm to myself or my property that may result from my use or test ride of a California eBikes vehicle or any equipment provided by California eBikes. This assumption of risk includes, without limitation, risks arising from the negligence of California eBikes and all related parties, including its shareholders, directors, officers, managers, members, employees, landlords, insurers, attorneys, and agents (collectively, the “California eBikes Parties”).

I further agree to fully release and forever discharge the California eBikes Parties from any and all claims, demands, losses, damages, or liabilities arising from my use, or my family’s use, of a California eBikes vehicle or associated equipment. This release applies regardless of whether such injury, loss, or damage is caused by my own actions, the actions of a family member, a California eBikes Party, or any other third party. Claims released include, but are not limited to, those arising from negligence; design, manufacturing, adjustment, maintenance, or inspection defects; failure to inspect or maintain riding areas; and failure to provide proper instruction, technical guidance, or safety equipment.

I agree that I will not file a lawsuit or make any claim against the California eBikes Parties for injuries or damages related to the use of California eBikes vehicles or equipment. This provision does not apply to claims involving gross negligence, willful misconduct, reckless conduct, or any liability that cannot be lawfully waived under California law.

I agree to indemnify, defend, and hold harmless the California eBikes Parties from and against any and all claims, demands, damages, losses, or liabilities related to California eBikes vehicles or supplied equipment, including claims arising from the negligence of the California eBikes Parties. I also agree to indemnify, defend, and hold harmless the California eBikes Parties for claims resulting from my own negligence or from any other claim connected to my use of a California eBikes vehicle or related equipment.

Consistent with these obligations, I agree to reimburse the California eBikes Parties for any damages, settlements that are reasonable, and all defense-related expenses, including attorneys’ fees, incurred as a result of such claims. I further agree that if I become deceased or incapacitated, this Agreement—including the indemnification obligations—shall remain binding on my estate and shall be enforceable against my heirs, personal representatives, executors, administrators, or guardians.

I acknowledge that this Agreement is intended to serve as a broad and enforceable release of liability and indemnification to the fullest extent permitted under California law. If any portion of this Agreement is determined to be invalid or unenforceable, such provision shall be modified or enforced to the maximum extent allowed by law in order to fulfill the intent of this Agreement.

This Agreement shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict-of-law principles. In any legal action challenging the validity or enforceability of this Agreement, I agree that the party contesting the Agreement shall be responsible for all attorneys’ fees and costs incurred by the parties seeking to enforce it. I confirm that I have carefully read this Agreement in full and understand its contents. I further agree that no verbal statements, promises, or representations have been made to me other than those contained in this document.

I acknowledge and agree that I am signing this Agreement voluntarily, without pressure or coercion, and that I have been provided sufficient time to review it prior to signing. I further acknowledge that I have the right to consult with legal counsel of my choosing before signing this Agreement.
